The prosecution objected to Bung Moktar’s application, Zizie Izette to review the self-defense decision

KUALA LUMPUR : The prosecution objected to the application of Datuk Seri Bung Moktar Radin and his wife Datin Seri Zizie Izette Abdul Samad to review the decision of the Sessions Court which ordered them to defend themselves on three charges of corruption amounting to RM2.8 million involving a RM150 million investment in Public Mutual Berhad unit trust.

According to Deputy Public Prosecutor, Low Chin How, his party submitted an initial objection in the Sessions Court here, on the grounds that the application should not have been filed through a notice of motion.

Cin How said again, the notice is against Sections 35 and 36 of the Court of Justice Act (CJA) 1964 read together with Sections 325 and 336 of the Criminal Procedure Code (CPC).

That article refers to the power given to the court to summon and inspect the record of proceedings.

“The objection will be filed in detail today. The review is heard at the discretion of the court, not on a notice of motion where the court has no choice and is forced to hear the merits of the review without discretion.

“We humbly protest that the method is wrong and does not exist in the law,” he said at the case proceedings before the High Court Judicial Commissioner, Datuk Azhar Abdul Hamid on Monday.

Earlier, Azhar allowed the couple’s defense request that the review of their corruption case be heard jointly.

Bung Moktar and his wife are represented by lawyers M Athimulan and Datuk K Kumaraendran.

The court then set November 11 for the next case hearing.

On October 7, High Court Judge, Datuk Collin Lawrence Sequerah, allowed Athimulan’s application, so that the notice of motion involving Zizie Izette be transferred to Azhar.

Bung Moktar, 64, and Zizie Izette, 44, filed a notice of motion to review the decision of the Sessions Court on September 2, which ordered them to defend themselves against corruption charges related to the RM150 million investment in Public Mutual’s unit trust.

On 3 May 2019, Bung Moktar who is also the former Non-Executive Chairman of FELCRA was charged with two charges of accepting bribes of RM2.2 million and RM262,500, as an inducement to obtain FELCRA’s approval to invest RM150 million in Public Mutual unit trusts.

In addition, the UMNO Supreme Working Council (MKT) member was also accused of accepting a bribe of RM337,500 from a trust unit consultant, Norhaili Ahmad Mokhtar under the name Zizie Izette, who is also facing three charges of abetting her husband.
