The hearing of the case of SM Faisal injuring his ex-wife was postponed to 25 Nov

KUALA LUMPUR: The trial of businessman Datuk SM Faisal SM Nasimuddin who is alleged to have caused injury to his ex-wife Emilia Hanafi, which was scheduled for today at the Magistrate’s Court here, has been postponed to Nov 25.

Lawyer Datuk Jagjit Singh who represented SM Faisal told the court that the businessman’s main lawyer Datuk Akberdin Abdul Kader was unable to attend today due to breathing problems and also submitted a sick leave certificate (MC), the lawyer in question to the court.

“Datuk Akberdin should have cross-examined the 6th prosecution witness, Elisa Nani Hanafi, who will be called to testify today. However, I humbly request that today’s case be postponed,” said Jagjit in front of Magistrate Nadia Othman.

Earlier, Deputy Public Prosecutor Zahida Zakaria said her party was ready to hear the testimony of Elisa Nani, Emilia’s sister today.

“The prosecution submitted a copy of witness Elisa Nani’s statement to the defense on Oct 30 (yesterday),” said Zahida.

Jagjit then confirmed that he had received a copy of the witness statement.

SM Faisal, 43, was charged with intentionally causing injury to Emila, 43, who at the time of the incident was his wife at a house in Desa Sri Hartamas, Brickfields here between 12.30pm and 4.30pm on 22 Nov 2015.

The charge is under Section 323 of the Penal Code and can be punished under Section 326A of the same code, which carries a maximum prison sentence of two years or a fine of up to RM2,000 or both, if convicted.
