The draftsman is charged with sending malicious communications

JOHOR BAHRU: A blueprint artist pleaded not guilty in the Sessions Court here today to four charges of making and initiating the transmission of obscene communications last year.

For the first to third charges and one amended charge, Muhammad Firdaus Embong, 39, as the person subject to the summons (OKS) is charged with using the Facebook application ‘Firdaus Embong’ to create and start sending communications in the form of pictures and texts of an ugly nature with the intention of hurting people’s hearts another.

The four transfers were allegedly made between 17 March 2022 to 18 August 2022 and were seen by the complainant at a bank in Kulai at 2pm, 14 Sept 2022.

The charge is made in accordance with Section 233 (1)(a) of the Communications and Multimedia Act 1998 which can be punished under Section 233(3) of the same act which provides for a fine of up to RM50,000 or a maximum imprisonment of one year or both, if convicted.

Judge Datuk Che Wan Zaidi Che Wan Ibrahim allowed Muhammad Firdaus to be bailed at RM20,000 for all charges with one surety and fixed May 15 for the case to be mentioned again.

The prosecution was handled by Malaysian Communications and Multimedia Commission (MCMC) Deputy Public Prosecutor Fazril Sani Mohamed Fadzil and MCMC Prosecuting Officer Mai Zairani Zainal Abidin while Muhammad Firdaus was not represented by a lawyer.
