SM Faisal v Caprice: lawyer says parties to discuss amicable settlement
SM Faisal sued Ariz as a defendant on August 15 last year in relation to allegations of uploading defamatory messages through his Instagram, linking the businessman to the case of his ex-wife Emilia Hanafi.
Court to hear case in Oct 4 to 6, 2023 if matter not resolved before then
KUALA LUMPUR: The parties in Datuk SM Faisal SM Nasimuddin Kamal’s lawsuit against rapper Caprice are trying to settle the case amicably before the trial starts on Oct 4, 2023 at the Sessions Court here.
Puteri Ummi Kartini’s lawyer Abd Latiff who represented SM Faisal said if there is no solution, the court will set Oct 4 to 6 next year to hear the case.
“Case management is set for July 3, 2023 for further trial instructions,” he said when contacted after online case management in front of Judge Azian Othman who was also joined by lawyer Harjoth Singh representing Caprice or real name Ariz Ramli.
SM Faisal sued Ariz as a defendant on August 15 last year in relation to allegations of uploading defamatory messages through his Instagram, linking the businessman to the case of his ex-wife Emilia Hanafi.
Based on the statement of claim, SM Faisal as the plaintiff said on June 27, the Kuala Lumpur Syariah High Court ordered Emilia to serve seven days in prison, after it was found that she had failed to comply with the court’s commitment order.
SM Faisal claimed that on June 28, Ariz defamed the plaintiff or the Syariah Court by uploading defamatory videos and messages, through the defendant’s Instagram, which, among other things, meant that he was a cruel and reckless man who wanted to imprison his ex-wife, in addition to being thoughtless and acting aggressively towards women or children.
The plaintiff seeks general, punitive, exemplary, severe and cost damages in addition to an injunction ordering the defendant to remove and delete the defamatory transmission.
