Nicotine in gels, liquids also exempted from Poisons Act

The federal gazette on the Poisons (Amendment of Poisons List) Order 2023 issued yesterday, states that nicotine, ‘used for smoking through electronic cigarettes and electric vaporising devices, in the form of liquid or gel’, is exempted from the list of poisons.

KUALA LUMPUR: The government gazetted the excise duty on vape liquids with nicotine content at a rate of 0.40 cents per milliliter effective today.

The Federal Government gazette notice was issued yesterday by the Prime Minister who is also the Minister of Finance, Datuk Seri Anwar Ibrahim.

The government also gazetted nicotine patches, liquids, and gels to help stop smoking, and vape liquids were exempted from the Poisons Act 1952.

According to the notice issued by Health Minister Dr Zaliha Mustafa on Friday, it is part of the Poisons Order Amending the Poisons List 2023.

The move continued even after several parties including the Poisons Board and the Malaysian Pharmaceutical Association rejected the proposed exemption of nicotine liquid from the Poisons Act 1952.
