
Mawar Karim managed to avoid the default judgment
BANGI: Businessman, Mawar Karim successfully set aside the default judgment obtained by businessman Nabil Mat Jahya against her in relation to a loan agreement amounting to RM720,000 at the Bandar Baru Bangi Sessions Court here on Friday.
Judge Effandi Nazila Abdullah ruled this during online proceedings.
When contacted by the media, lawyer Datuk Mohd Imran Tamrin who represented Mawar said, following the decision, Mawar will continue his action by filing a defence.
“The counterclaim against the parties named in this case will be made within 14 days from Friday,” he said.
This proceeding was also attended by lawyer Nik Zarith Nik Moustpha representing Nabil.
On January 11, Nabil as the plaintiff was given permission by the court to obtain a default judgment against Mawar, after the entrepreneur failed to enter an appearance in the suit filed by the plaintiff.
Based on the default judgment, the defendant (Mawar) has to repay the loan that the plaintiff has given to the defendant amounting to RM720,000.
Mawar in the supporting affidavit to set aside the default judgment said that she never received a sealed copy of the default judgment from the plaintiff or her lawyer, at all material times until the notice of appointment of a lawyer dated April 14 was filed by his lawyer.
Based on the statement of claim, Nabil demanded money amounting to RM720,000 which had been given to the defendant, in accordance with the Friendship Loan Agreement which had been agreed and signed by them.
Nabil claimed that in the agreement, the defendant must repay RM100,000 before or on every 1st of the month for six consecutive months starting June 1, 2021, while for the last month, which is the seventh month, Mawar must pay RM120,000 as the final payment for the loan the said.
