Lawyer informs parties have discussed, reached settlement over injury accusation
Emilia Hanafi has withdrawn her case against ex-husband Datuk SM Faisal SM Nasimuddin over the charge of injuring her eight years ago, which led to the court to discharge and acquit the businessman.
KUALA LUMPUR: The Magistrate’s Court today acquitted Datuk SM Faisal SM Nasimuddin of the charge of injuring his ex-wife Emilia Hanafi, eight years ago after the woman withdrew the case against the businessman.
Magistrate Nadia Othman made the decision, after allowing the request of lawyer Datuk Akberdin Abdul Kader, who represented SM Faisal, for his client to be released and released, after Emilia who was the complainant and also the last prosecution witness agreed to withdraw the case.
“I believe the parties have reconciled and reached a solution. Therefore the accused was released and released and the bail money returned,” said Nadia.
Earlier, the observing lawyer on behalf of Emilia, Nizam Bashir informed the court that the parties involved had discussed since yesterday and finally reached a solution involving the dispute between them.
Deputy Public Prosecutor Nur Aishah Ahmad Zakiuddin called Emilia to the witness stand to confirm the matter.
“Since there is a solution, I would like to withdraw this case. I also understand the consequences if I withdraw the case, the charges cannot be continued against the accused,” said Emilia when questioned by Nur Aishah at today’s proceedings, which should have been set to continue.
Nur Aishah then requested that SM Faisal be released without being released, following confirmation from Emilia, but Akberdin requested that his client be released and released following the withdrawal of the case by the woman.
When met by reporters outside the court, Nizam said the case was successfully resolved after both parties agreed on the terms of the promised settlement.
“The case was successfully resolved and the basis of the resolution is the blessing of the month of Ramadan in addition to the benefit of the children (referring to SM’s three children Faisal and Emilia). There are terms of agreement but there is no need to reveal them, we celebrate the successful agreement reached,” he said.
Meanwhile, Akberdin said both parties agreed not to disclose the terms of the settlement to the public.
“This settlement also involves a case in the Syariah Court which is a case of adultery and matrimonial property. The parties will take action to inform the court, not to proceed with other cases. We hope that after this everything will go smoothly,” said the lawyer.
Meanwhile, SM Faisal and Emilia when met by reporters expressed their gratitude for the solution and will give full focus to the children.
SM Faisal was charged with injuring Emilia at a house in Desa Sri Hartamas, Brickfields here between 12.30pm and 4.30pm on 22 Nov 2015 according to Section 323 of the Penal Code and can be punished according to Section 326A of the same code which carries a maximum sentence of two years in prison or a fine of RM2. 000 or both, if convicted.
