Emilia seen scared, crying, complaining SM Faisal hit her – Witness

KUALA LUMPUR: A member of the police patrol told the Magistrate’s Court here today that the ex-wife of Datuk SM Faisal SM Nasimuddin was seen in a state of fear, crying and complaining that the businessman had beaten her in a house in Desa Sri Hartamas where the couple lived for seven years. off

Sergeant Saleh Omar Osman, 43, from the Patrol Car Branch, Brickfields District Police Headquarters said on 22 Nov 2015, he received a call from the control center stating that there was a fight at the house and proceeded to the location with his colleagues.

The fourth prosecution witness said when he arrived at the house, the gate was open and he saw a man standing in the parking area and allowed them to enter.

“My colleague asked the man ‘is there any problem sir’ and the man replied ‘nothing.’ After that, a woman came out of the house and showed me the bruises on her hands from being beaten, and I also saw bruises on her face.

“The victim was in fear, crying and complaining that her husband (while pointing to the man) had hit her. The man just remained silent,” he said while reading the witness statement at the trial of SM Faisal who allegedly injured Emilia Hanafi.

During the main examination by Deputy Public Prosecutor Nur Aishah Ahmad Zakiuddin, the witness identified the man standing in the parking area as SM Faisal.

According to Saleh, he then asked the victim to make a report at the Sri Hartamas Police Station.

During cross-examination by lawyer Datuk Akberdin Abdul Kader, the witness agreed that he did not arrest SM Faisal despite having the authority to arrest any suspect suspected of committing a crime.

Akberdin: I’m telling you Sergeant, you didn’t arrest him even though you saw bruises on the woman’s eyes and hands because you decided it was a domestic matter between a man and a woman, that’s why you didn’t arrest or detain the suspect.

Saleh: Yes, I agree.

However, the witness did not agree with the lawyer’s suggestion that on the day of the incident, SM Faisal had told him that he had been attacked by his wife and had to defend himself causing them to suffer injuries.

SM Faisal, 43, is facing charges of intentionally causing injury to Emilia, 43, who was his wife (at the time of the incident) at a house in Desa Sri Hartamas, Brickfields here between 12.30pm and 4.30pm on 22 Nov 2015.

He was charged under Section 323 of the Penal Code and can be punished under Section 326A of the same code which carries a maximum sentence of two years in prison or a fine of RM2,000 or both, if convicted.

The hearing before Magistrate Nadia Othman continues tomorrow.
