Comedy club owner faces three counts on alleged racially sensitive social media clips
Crackhouse Comedy Club owner Mohamad Rizal van Geyzel will be on trial on June 1 and 2 for allegedly creating and distributing social media clips touching on racial sensitivity.
KUALA LUMPUR: The decision of the representation of the founder and co-owner of Crackhouse Comedy Club, Mohamad Rizal Van Geyzel to drop the three charges of making and starting to send videos that touch on racial sensitivity in the social media application he faced at the Sessions Court here on Thursday is set for next May 31.
If the Attorney General’s Office (AGC) rejects the representation, Judge N Priscilla set the hearing of the case to continue on June 1 and 2.
During the proceedings, Deputy Public Prosecutor, Noor Aslinda Che Seman said, the second letter of representation was received on Thursday, so the prosecution asked for a period of one month to bring it to the superiors.
According to her, the additional documents will be submitted to the defense team on another date because the investigating officer could not be present due to his wife’s health problems.
Meanwhile, lawyer M Pravin said that very important new development information had been included in the second representation in an effort to drop the charges against his client.
“Therefore, we request that the hearing of the case be postponed until next June pending the decision of the representation.
“Our side will also submit an application to temporarily obtain the client’s passport to enable him to perform Umrah next May 15 to 30,” he said.
The court then adjourned the hearing set for April 14 and May 2, 3 and 22.
On January 20, the court was informed that Rizal’s first representation was rejected by the AGC and that the accused would file a second representation on the same issue.
Mohamad Rizal, 40, is charged with making and initiating the transmission of offensive communications with the intention of hurting others through the Facebook application using the profile name ‘Rizal van Geyzel, Instagram ‘rizalvangeyzel’ and TikTok ‘rizalvangeyzel’, between 4 to 6 July 2022.
The three dispatches were read at the Office of the Cyber and Multimedia Crime Investigation Division, Commercial Crime Investigation Department, KPJ Tower here, at 1.17pm, 13 July last year.
The three charges are presented in accordance with Section 233 (1) (a) of the Communications and Multimedia Act 1998 and are punished in accordance with Section 233 (3) of the same act which carries a maximum fine of RM50,000 or a maximum imprisonment of one year or both and can be fined RM1 ,000 for each day the offense continues after conviction, if convicted.
