Bung Moktar, Zizie Izette case is set for May 22

PUTRAJAYA: The Court of Appeal has yet to set a date for the hearing of Datuk Seri Bung Moktar Radin and his wife Datin Seri Zizie Izette Abdul Samad’s appeal against the High Court’s decision to dismiss the application for review of the Sessions Court’s decision.

This is because the appeal record has not yet been finalized and accordingly the date for the extension of case management is set for next May 22 by the Deputy Registrar of the Court of Appeal Syahliza Warnoh who handles the management of the appeal case today.

Deputy Public Prosecutors Law Chin How and Teh See Khoon, lawyers representing Bung Mokhtar and Zizie Izette when contacted by Bernama confirmed that the extension date for the case management was set due to the record of the appeal that has not been finalized.

On Sept 2 last year, the Sessions Court ordered the Kinabatangan Member of Parliament and his wife to defend themselves against three charges of corruption amounting to RM2.8 million involving a RM150 million investment in Public Mutual Bhd’s unit trust.

On Dec 9 last year, Judicial Commissioner Datuk Azhar Abdul Hamid rejected the couple’s application to review the Sessions Court’s decision which caused them to appeal at the Court of Appeal.

The court rejected the application after allowing the prosecution’s initial objection on the grounds that Bung Moktar and Zizie Izette had used the wrong method to file the review application.

The prosecution argued that the two should not have filed by way of a notice of motion but rather by letter to the High Court.

On 3 May 2019, Bung Moktar was charged with two charges of accepting bribes of RM2.2 million and RM262,500 as an inducement to obtain FELCRA approval to invest RM150 million in Public Mutual unit trusts.

He allegedly accepted a bribe from a Public Mutual investment agent through Zizie Izette at Public Bank Taman Melawati Branch here between 12.30pm and 5pm, 12 June 2015.

Bung Moktar was also charged with receiving RM337,500 in cash from a Unit Amanah consultant, under the name of Zizie Izette for the same reason and at the same place on 19 June 2015 while Zizie Izette is facing three charges of abetting her husband in relation to the matter at the same place, date and time same
