Bad communication case: Fahmi Reza submits representation to the Attorney General’s Chambers
KUALA LUMPUR: Graphic designer and activist Mohd Fahmi Reza Mohd Zarin or known as Fahmi Reza submitted a representation to the Attorney -General’s Chambers on two charges of sending obscene communications uploaded through his Twitter and Facebook social media sites, last year.
The matter was informed by lawyer N.Yohendra who represented Mohd Fahmi Reza, 45, during the mention of the case today before Sessions Court Judge MM Edwin Paramjothy.
Yohendra said the letter of representation was sent to the Attorney -General’s Chambers yesterday (April 28) and the original copy of the representation was handed over to the prosecution today.
The matter was confirmed by Deputy Public Prosecutor Najihah Farhana Che Awang.
The two allegations of obscene communication were related to the issue of quarantine rules against ministers returning from official visits abroad and the ban on the sale of liquor in the country.
In the proceedings, the court has set the hearing dates on July 7 and 20 for the charge of obscene communication on the minister’s quarantine issue while August 8 and 9 for obscene communication on the issue of liquor.
The court also set June 8 for mention for the development of the representation.
On Feb 10, Mohd Fahmi Reza pleaded not guilty at the Sessions Court here to the charge of sending obscene communications through his Twitter application involving the issue of quarantine against the minister returning from an official visit abroad.
Mohd Fahmi Reza was accused of making and initiating the transmission of obscene communications with the intention of offending others through the Twitter application using the Twitter profile page “Fahmi Reza” or “@kuasasiswa” at 3.02 pm, 10 Feb 2021. The transmission was then read at the Head Office Corporate Communication Unit, Ministry of Health Malaysia, Precinct 1, Putrajaya at 4 pm, 11 Feb the same year.
On Feb 17, Mohd Fahmi Reza Mohd Zarin was charged again in the Sessions Court and pleaded not guilty to the same offense regarding the issue of banning the sale of liquor in the country.
According to the charge, he was accused of knowingly making and initiating the transmission of obscene communications regarding the issue of banning the sale of liquor in the country, with intent to offend others through his Facebook page using the profile “Fahmi Reza” at 11.45am, June 1, 2021. The delivery was then read at a unit of Pangsapuri Melur, Sentul Perdana, Bandar Baru Sentul here, at 9 am, 2 June 2021.
All charges are submitted in accordance with Section 233 (1) (a) of the Communications and Multimedia Act 1998 and are punishable under Section 233 (3) of the same act, which carries a maximum fine of RM50,000 or imprisonment not exceeding one year or both and shall be fined further RM1,000 for each day the offense is continued after conviction, if convicted.
