Case management set for April 10, says lawyer of Mongolian model’s family

The father of deceased Mongolian woman Altantuya Shaariibuu, Dr Shaariibuu Setev, and his family have argued in their suit that Altantuya’s death caused them mental shock and psychological trauma.

Government and political analyst, Abdul Razak Baginda has filed an appeal against the decision of the Shah Alam High Court which allowed the suit of the family of the late Altantuya Shaariibuu regarding the death of the woman in 2006.

KUALA LUMPUR: The government and political analyst, Abdul Razak Baginda have filed an appeal against the decision of the Shah Alam High Court which allowed the suit of the family of Mongolian model, the late Altantuya Shaariibuu regarding the woman’s death in 2006.

The government filed a notice of appeal at the Court of Appeal last Monday while Abdul Razak last Tuesday.

Lawyer Harshaan Zamani who represents the model’s family when contacted by reporters confirmed the matter and informed that he had received a copy of the appeal notice.

“The appeal is set for case management on April 10 before the Deputy Registrar of the Norshakinah Court of Appeal Ahmad Kamarudin,” said the lawyer.

Altantuya’s parents, Dr Shaariibuu Setev and Altantsetseg Sanjaa and their grandson Mungunshagai Bayarjargal as plaintiffs filed a RM100 million suit on 4 June 2007 naming two former members of the Special Action Unit (UTK), Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar and Abdul Razak and Malaysian government as defendant.

On Dec 16 last year, Judge Datuk Vazeer Alam Mydin Meera, who is now a Court of Appeal Judge, allowed the suit and ordered the defendants to jointly pay general, severe and exemplary damages of RM5 million to the family.

The judge also ordered the four defendants to each pay RM25,000 in costs.

In a statement of claim, the family claimed that Altantuya’s death had caused them to suffer mental shock and psychological trauma which entitled them to exemplary and severe damages.
